Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason (exceptions: purchases of content on non-physical data carriers, see below, and scheduled events. The latter have cancellation options, as set out in the course terms and conditions). The withdrawal period is fourteen days from the day on which you, or a third party designated by you (other than the carrier), took possession of the last item. To exercise your right of withdrawal, you must inform us (Dietz & Hohage GbR, Kaiserring 20, 68161 Mannheim, Germany, info@ema-musik.eu) by means of a clear statement (e.g. a letter sent by post, an email, or via the online withdrawal form) of your decision to withdraw from this contract (or parts of the contract). You may also use the attached model withdrawal form for this purpose, although this is not mandatory. If you use the online withdrawal form, we will immediately send you a confirmation of receipt on a durable medium (e.g. by email). Your notification will then be reviewed as soon as possible. To meet the withdrawal deadline, it is sufficient for you to send notification of your exercise of the right of withdrawal before the withdrawal period expires.
Right of cancellation for the purchase of content on non-physical data carriers
According to § 356 paragraph 5 BGB, the right of cancellation for the purchase of content on non-physical data carriers expires as soon as we have started to execute the contract. We have begun with the execution after you have expressly agreed that we may begin with the execution of the contract before the expiry of the cancellation period and you have confirmed your knowledge that you lose your right of cancellation by your consent with the beginning of the execution.
Consequences of cancellation
If you withdraw from this contract, we shall refund the price of the product (excluding delivery costs) that we received from you without delay and at the latest within fourteen days of the day on which we received notification of your withdrawal from this contract. We shall use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees in connection with this refund. We may withhold the refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.
You must return the goods to us without delay and, in any event, no later than fourteen days from the date on which you notify us of your withdrawal from this contract, or hand them over to us by prior arrangement. The deadline is met if you dispatch the goods before the period of fourteen days has expired. You shall only be liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
The right of cancellation does not apply to the following contracts:
- Contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
